This Privacy Policy (“Policy”) addresses how Miner, Ltd. (“Miner”) collects, uses, and discloses your information when you visit www.minercorp.com (the “Website”) or interact with Miner. References in this Policy to “we,” “our,” or “us” means Miner.  When we refer to “you,” or “your,” we are referencing you, the individual user or person that interacts with us through the Website, email or by telephone.  In connection with your use of the App (defined below) references to “User” means the individual who has downloaded and is using the App.

What Information Does Miner Collect?

Information Collected on the Website

  • When you use the “Schedule Service” function on our Website, we will collect your first name, last name, company, street address, city, state, zip code, phone number, the type or name of the equipment or asset in need of service, the location of that equipment or asset, a description of the problem with the equipment or asset, any photos of the equipment or asset, a purchase order number, a not to exceed amount (in dollars), the priority based upon the options available in the drop-down box, your email address, and we request that you choose an option from a drop-down box about how you found us. As part of this form, we will also request you to opt-in to allowing us to deploy a cookie to save the information in this form so that you do not have to provide all of the same information during your next visit to the Website.  You have the option to opt-in and enroll to receive text messages in connection with scheduling our services.
  • If you choose to use the search function on our Website, we will collect your search string as part of that function.
  • In the event you use the “Request a Quote” function, we will collect your first name, last name, company name, email address, phone number, your role in the organization, mailing address (optional), city (optional), state, zip code and a description of the project that you want a quote for.
  • In connection with applying for a job opening, you will be redirected to a Careers Portal, which is operated by our third party service provider, who will collect your first name, middle name, last name, email address, and cell phone number, home phone number, preferred name, whether you have ever applied with us before, your address, city, state, zip code, an available start date for employment, desired salary type, LinkedIn profile, salary range, the name of anyone who may have referred you to us, information about how you learned about us, and whether you have ever worked for us in the past.
  • If you click the Contact Us hyperlink and fill out the form, we will collect your first name, last name, company name, email address, telephone number (optional), zip code, your role with the organization (optional), and the contents of any message you choose to send us.
  • Our Website collects information from internet cookies. For more information about how we collect and use information collected from cookies, please visit the “Internet Cookies – Cookie Policy” portion of this document, which is included below.

Collected from Telephone Calls and Mailed Correspondence

If you choose to contact us by telephone by dialing (844) 646-3787, which is a toll-free phone call, we will collect your first name, last name, company name, telephone number, and any other information in relation to your inquiry, to the extent you choose to provide us with such information.  When you contact us by written correspondence, via U.S. mail, we will collect your name, mailing address, and any other pertinent details related to your inquiry, to the extent you provide those details in the correspondence.

Information Collected from the App

The information we collect from you while using our Miner Site Survey Mobile Application (the “App”) includes the make, model and serial number of a piece of equipment or company asset, pictures of that equipment or company asset, your geographic location, and the features and condition of each piece of equipment or asset that you input details about.  We will also collect your login credentials.

How Does Miner Use the Information it Collects? 

Information from the Website

  • The information we collect from the “Schedule Service” form on our Website is used to administer, coordinate, and schedule a service technician to render the requested services, for account administration and customer service, and for our advertising, marketing, and promotional efforts, including sending you email communications about products, services and other items that we think you might be interested in, which you may opt-out of at any time by following the instructions to unsubscribe that are included at the bottom of each such email message.
  • If you choose to provide us with a mobile or cell phone number, we will use this telephone number for purposes of sending you text messages about your service appointment and other relevant information regarding our business.  You hereby acknowledge and agree that: (i) you are not required to grant consent as a condition of buying any goods or services, (ii) you may revoke your consent at any time by contacting us info@minercorp.com, (iii) message and data rates may apply to text messages, and (iv) if your contact information changes, you should inform us by contacting: info@minercorp.com.
  • We use the information we collect from the search function to complete the search and provide you with results, which is facilitated by a third party service provider.
  • The information you provide to us using the “Request a Quote” form is used by us to respond to you with a quote for the service you have described or to contact you for more information, to the extent necessary, to provide you with a more accurate quote. We also use this information for our advertising, marketing and promotional efforts, including sending you email communications about products, services and other items that we think you might be interested in, which you may opt-out of at any time by following the instructions to unsubscribe that are included at the bottom of each such email message.
  • Should you choose to apply for a job opening, we will use the information we receive from our third party service provider in connection with our application and hiring process.
  • Under circumstances where you complete any other form that might enable you to contact us with a comment or question, we will use that information to respond to your inquiry and for our advertising, marketing and promotional efforts, including sending you email communications about products, services and other items that we think you might be interested in, which you may opt-out of at any time by following the instructions to unsubscribe that are included at the bottom of each such email message.

We use the information we collect from the application to update our records about the particular condition of a given piece of equipment or asset and to provide quotes and recommendations to our customers based on the data for docks, doors, fans, and any other relevant products and services.

Internet Cookies – Cookie Policy

Our website utilizes internet cookies, which are small files that our Website transfers to your computing device through your web browser (if you have chosen to allow or permit cookies in your browser settings). Internet Cookies allow us to capture certain information from your computer, including your computing device type, the operating system that you use, the name of your internet browser, your internet browsing history, the date and time you arrived on the Website, the amount of time you spent browsing each page on the Website, your internet protocol address, a unique online identifier, your geographic location, preferred language, and other statistical information.  Our Website utilizes Google Analytics to help us understand basic demographic information about our users.

Third Party Service Providers

In connection with offering you the content and functionality available on the Website, we utilize third party service providers.  These third party service providers include website and data hosting, web and mobile application, email marketing, software, marketing, advertising, logistics, accounting, and legal service providers.  These third party service providers are prohibited from using information such as your name, email address, or telephone number for any other purpose other than to render their services to us.

We also utilize Analytics providers, which deploy their own cookies on the Website, which enable them to collect information directly from you when you browse the Website.

Marketing and Advertising

We utilize the information contained in our customer relationship management system, which is maintained by our third party service provider, for purposes of facilitating our marketing efforts, including direct email marketing campaigns. We do not share mobile or cell phone information with third parties or affiliates for any marketing or promotional purposes.

Compliance with Law; Preservation of Rights

We also reserve the right to disclose any information you have made available to us if its release is required for disclosure, as determined in our sole discretion, to comply with our obligations under the law or to protect the rights, property, or safety of Miner, our customers, and other persons.

Sale of the Company

In the event that Miner, or substantially all of our assets are sold, or we reorganize or merge into another company, your information will be among one of the transferred assets included in the transaction.

Do Not Track Signals or Requests

Our Website does not respond to or otherwise acknowledge Do Not Track signals or requests from internet web browsers.

Privacy Policy for California Residents

This Privacy Policy for California residents is intended to supplement the information contained in the Privacy Policy above and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this Policy.

Right to Know and Data Portability

Right to Delete

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions (the “Right to Delete”). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or de-identify Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Exercising Your Rights to Know or Delete

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your Personal Information. To designate an authorized agent, you must contact us at 1-844-646-3787 or by sending us an email at info@minercorp.com and providing us with the relevant contact details for your authorized representative so that we may verify their information and your information should the authorized agent make any request on your behalf.

You may also make a request to know or delete on behalf of your child by contacting us at 1-844-646-3787 and providing us with the child’s name and email address and information that establishes you as the parent or legal guardian of the child.

You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
    • Verifying information that you provide in the request with the information that we have on file for the person whom you are requesting us to take action.
    • We will verify the information for the child that you are making a request about against the information that you provide us and any reasonably necessary information that we may require to make reasonable efforts to determine that the person making the request is the parent or legal guardian over the child.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

You do not need to create an account with us to submit a request to know or delete.

We will only use Personal Information provided in the request to verify the requestor’s identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please info@minercorp.com and include “California Data Request.”

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specially PDF.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. We do not currently provide any financial incentives.

Changes to Our Privacy Policy

We reserve the right to amend this privacy policy at our discretion and at any time. When we make changes to this privacy policy, we will post the updated notice on the Website and update the notice’s effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.

European Union (EU) and United Kingdom (UK) General Data Protection Regulation (GDPR) Disclosures

The EU’s GDPR and the UK Data Protection Act require us to provide data subjects with certain disclosures about their data rights and our collection and processing of personal data.  For purposes of this Section on GDPR disclosures, references to terms such as “controller,” “data subject,” “personal data,” “processor,” or “supervisory authority” in this Section shall have the meanings set forth in Regulation (EU) 2016/679 of the European Parliament and of the European Council, dated 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

Purposes of Processing

If you provide us with your personal data in connection with scheduling services, the legal basis for our processing of scheduling information is your consent and processing that is necessary to carry out a contract with you or your employer.  The legal basis for the processing of your mobile telephone data to send you text messages is your consent.  If you utilize our search function, request a quote from us, submit personal data for a job opening, or contact us with a question, the legal basis for our processing activities is both your consent and our legitimate interests in respond to inquiries to our business.

Recipients of Personal Data

We provide personal data to third parties as detailed above in our Privacy Policy, which includes third party service providers who render their services to us.  These third parties include website and data hosting, web and mobile application developers, software, email marketing, accounting, logistics, legal and analytics service providers.

Data Transfers

To the extent that a data transfer is required outside of the European Economic Arena or UK, as applicable, we will comply with all applicable data privacy laws, including utilizing approved mechanisms for transferring personal data, including the Standard Contractual Clauses, as approved by the EU Commission and those clauses approved by the UK’s Information Commissioner’s Office.

We will retain personal data until such time as contacted by you to request deletion of such personal data.

Data Rights

Data subjects are afforded certain rights under the GDPR, which includes all of the following:
